RIGHT OF WITHDRAWAL FROM THE AGREEMENT

  1. A customer who is not a consumer within the meaning of Art. 221 of the Civil Code or a natural person concluding a contract directly related to their business activity, when the content of this contract indicates that it is of a professional nature for them, resulting in particular from the subject of their business activity, made available under the provisions of the Central Register and Information on Business Activity, does not have the right to withdraw from the sales contract or service reservation contract within 14 days
  2. The right to withdraw from a distance contract also does not apply to the customer in relation to products created and prepared at the customer's special request, for example to the dimensions provided by them, as well as in relation to a service contract, if Viscar has fully performed the service with the express consent of the Customer, who was informed before the commencement of the service that after Viscar has performed the service, they will lose the right to withdraw from the contract.

COMPLAINTS

  1. The customer has the right to file a complaint regarding the product.
  2. A customer who placed an order via telephone conversation is not entitled to file a complaint regarding the product unless, after receiving a summary of the order placed by telephone, sent to the e-mail address provided during the telephone conversation, the customer immediately confirms in response to this e-mail that the order recorded by Viscar is consistent with the order placed by him/her via telephone. The order will not be fulfilled until Viscar receives such confirmation.
  3. The Customer may submit a complaint to Viscar using the following communication channels:
    • by email;
    • in writing.
  4. The complaint should include at least the first name, last name and e-mail address of the Customer or correspondence address to which Viscar is to respond to the complaint, the company name in the case of a Customer who is an entrepreneur, the order number, the product description and a description of the reported reservations together with the Customer's request related to the submitted complaint.
  5. Viscar reserves the right to leave without consideration complaints that do not meet the conditions specified in paragraph 3, in particular when the information provided does not allow the Customer to be identified or contacted in order to clarify the complaint.
  6. Viscar considers submitted complaints within 14 days from the date of receipt of all information necessary to consider it. In particularly complicated cases, making it impossible to consider a complaint within 14 days, Viscar reserves the right to extend the complaint consideration period to 30 days. In such a case, Viscar will inform the customer about the extension of the complaint consideration period before the expiry of the 14-day period, stating the reason for the delay.
  7. The customer is obliged to deliver the product subject to the complaint in its original packaging to the Viscar office at their own expense and risk.
