I. GENERAL PROVISIONS

  1. These Regulations define the type and scope of services provided by Interspin operating under the Viscar brand, with a sales office in Warsaw at ul. Konduktorska 4 lok 019 00-775 Warsaw, the terms of their provision, as well as the general terms of sale, the terms of concluding and terminating agreements and the complaint procedure in connection with making purchases for the business activity conducted by the Client.
  2. These Regulations are available free of charge, also via the Website, which enables obtaining, reproducing, recording the content of the Regulations using the IT system used by the Client.
  3. The Regulations constitute a model contract concluded at a distance. The content of the Regulations in the case of using the services indicated in the Regulations constitutes the content of the agreement concluded between the parties.
  4. When using the services, the customer is prohibited from providing content of an illegal nature.
  5. Before using the services, the customer is obliged to read the Regulations and accept their provisions.
  6. The customer can only be a professional entity making purchases for the purpose of its business activity, registered in the Central Register and Information on Business Activity or in the National Court Register or in the relevant registers in the European Union.

II. PLACING ORDERS IN THE STORE AND SHIPPING ORDERS

  1. The prices given in the Store are expressed in Polish zloty (PLN) and are net prices.
  2. Viscar issues VAT invoices.
  3. Viscar undertakes to deliver products free from physical and legal defects.
  4. The Customer is obliged to use the Products offered by Viscar in a manner consistent with the regulations in force in the territory of the Republic of Poland and in accordance with the provisions of the Regulations.
  5. Information on delivery costs is provided at the time of determining the details of the order and depends on the type and quantity of products and the choice of the supplier who is to deliver the product to the buyer.
  6. By placing an order with Viscar, the Customer undertakes to pay for the products ordered.
  7. Viscar delivers goods via the courier companies UPS, DHL and Sash Express. The shipment is carried out on behalf of the buyer. The buyer grants the seller a power of attorney to conclude an agreement with the courier company on his behalf.
  8. When receiving the delivered shipment, the customer is obliged to check its technical and physical condition. In the event of damage to the shipment, it is recommended to draw up a damage report in the presence of the courier and notify Viscar about it. The damage report is helpful in conducting the complaint procedure, and its absence may make it difficult for the customer to pursue any claims and determine the person responsible for the damage. Complaints regarding damage incurred during shipment submitted by a customer who is not a consumer will not be considered without an attached damage report.
  9. The fulfillment of an order covering physical products consists of completing the ordered products (if available in the store) or making them in accordance with the placed order (and within the time agreed between Viscar and the customer), then packing them for delivery to the customer and sending the parcel to the customer in accordance with the form of delivery of the order chosen by them.
  10. The order is considered fulfilled at the moment of sending the parcel to the customer (entrusting the parcel to the carrier engaged in transport).
  11. The order fulfillment time depends on the product and is individually agreed with the customer. The ordered products should be issued to the customer within 7 days, unless a longer period has been clearly indicated by Viscar in the product description. In such a situation, when placing an order, the customer agrees to a longer order completion time resulting from the product description.
  12. If the customer has ordered products with different completion times, the binding order completion time for Viscar is the longest of all products included in the order, whereby the seller may propose dividing the order into several independent shipments in order to speed up the completion time for some products.
  13. Products can only be ordered via the https://ultimafilm.com/ webshop system. In exceptional situations, the customer may place an order by phone, but such an order is subject to an additional handling fee of PLN 25 net for one order.

III. RIGHT OF WITHDRAWAL FROM THE AGREEMENT

  1. A customer who is not a consumer within the meaning of Art. 221 of the Civil Code or a natural person concluding a contract directly related to their business activity, when the content of this contract indicates that it is of a professional nature for them, resulting in particular from the subject of their business activity, made available under the provisions of the Central Register and Information on Business Activity, does not have the right to withdraw from the sales contract or service reservation contract within 14 days
  2. The right to withdraw from a distance contract also does not apply to the customer in relation to products created and prepared at the customer's special request, for example to the dimensions provided by them, as well as in relation to a service contract, if Viscar has fully performed the service with the express consent of the Customer, who was informed before the commencement of the service that after Viscar has performed the service, they will lose the right to withdraw from the contract.

IV. COMPLAINTS

  1. The customer has the right to file a complaint regarding the product.
  2. A customer who placed an order via telephone conversation is not entitled to file a complaint regarding the product unless, after receiving a summary of the order placed by telephone, sent to the e-mail address provided during the telephone conversation, the customer immediately confirms in response to this e-mail that the order recorded by Viscar is consistent with the order placed by him/her via telephone. The order will not be fulfilled until Viscar receives such confirmation.
  3. The Customer may submit a complaint to Viscar using the following communication channels:
    • by email;
    • in writing.
  4. The complaint should include at least the first name, last name and e-mail address of the Customer or correspondence address to which Viscar is to respond to the complaint, the company name in the case of a Customer who is an entrepreneur, the order number, the product description and a description of the reported reservations together with the Customer's request related to the submitted complaint.
  5. Viscar reserves the right to leave without consideration complaints that do not meet the conditions specified in paragraph 3, in particular when the information provided does not allow the Customer to be identified or contacted in order to clarify the complaint.
  6. Viscar considers submitted complaints within 14 days from the date of receipt of all information necessary to consider it. In particularly complicated cases, making it impossible to consider a complaint within 14 days, Viscar reserves the right to extend the complaint consideration period to 30 days. In such a case, Viscar will inform the customer about the extension of the complaint consideration period before the expiry of the 14-day period, stating the reason for the delay.
  7. The customer is obliged to deliver the product subject to the complaint in its original packaging to the Viscar office at their own expense and risk.

V. FINAL PROVISIONS

  1. Viscar reserves the right to make changes to the Regulations for important reasons, in particular changes in legal regulations, changes in payment methods - to the extent to which these changes affect the implementation of the provisions of these Regulations. Viscar will inform the customer about each change at least 7 days in advance.
